1. Agreement To These Terms

1.1 These Terms of Use ("Terms") govern your use of wantwebdesign.com and any pages, forms and content on it (the "Site"), which is operated by Slaton Consulting, doing business as Want Web Design ("Want Web Design," "we," "us" or "our"), based in Houston, Texas. By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1.2 You must be at least 18 years old to use the Site's forms or request services. If you use the Site on behalf of a business, you confirm that you have authority to do so for that business.

2. Pricing Information Is Not An Offer

2.1 General information only. Prices, package descriptions, payment-plan examples, timelines and other service information on the Site are general information to help you decide whether to contact us. They are not an offer that can be accepted, and they do not create a contract. Prices and plans may change at any time without notice, and "from" prices (such as for the Growth package) depend on the scope set out in a written proposal.

2.2 Services are governed by the signed agreement. We provide website design, hosting, Care Plan, SEO and other services only under a written Website Design & Services Agreement signed by you and us (the "Agreement"). The price, scope, payment option and other terms that apply to you are the ones stated in your signed Agreement and its Schedule A. If anything on the Site or in these Terms conflicts with your signed Agreement, the signed Agreement controls. Submitting a form or receiving a quote does not obligate either of us to enter into an Agreement.

2.3 Taxes and third-party costs. Prices on the Site do not include sales tax (if applicable) or third-party costs such as premium plugins, themes, stock photos, domain registration, payment processing or advertising spend, unless stated otherwise in your Agreement.

3. Summary Of Payment Options

3.1 So that you know what to expect before signing, our standard payment terms are summarized below. This summary is for information only; your signed Agreement governs.

• Pay in full: 50% at signing and 50% at launch. You own the website at launch once it is paid in full.
• 24-month plan: a low or no down payment and 24 monthly payments, with the Care Plan (hosting, security, backups, updates and small edits) included for the full term. You own the website after the 24th payment.
• Business clients: payment plans are offered only for business or commercial purposes. Clients buying for personal, family or household use may choose the pay-in-full option.
• Early payoff: you may pay off a plan at any time with no penalty. You pay only the remaining website balance; you are never charged for Care Plan months not yet provided.
• Late payments: there is a 10-day grace period after each due date. After that, a late charge of the greater of 5% of the late payment or $7.50 (never more than $25, and never more than allowed by law) applies, once per late payment.
• Suspension: we suspend a website for non-payment only if a payment is at least 30 days past due, we have sent you written notice by email, and you have not paid within 10 days after that notice. A suspended website shows a maintenance page. We restore it within 2 business days after the past-due amount and any reactivation charge stated in your signed Agreement are paid.
• Your property is never withheld: your domain name, your content, your email and your customer or form data belong to you and are never held back to collect a payment, even if your account is past due. On written request we will transfer your domain (subject only to reimbursement of domain fees we paid) and export your content and data.
• No guaranteed results: we do not guarantee any search ranking, traffic, leads or sales.

4. Using The Site

4.1 Permitted use. You may use the Site for lawful purposes, to learn about our services and to contact us. You agree not to:

• use the Site in any way that breaks the law or infringes anyone's rights;
• submit false, misleading or spam content through our forms, or impersonate any person or business;
• attempt to gain unauthorized access to the Site, its servers or any connected systems, or interfere with its security or operation (including by introducing malware);
• use bots, scrapers or other automated means to collect content or data from the Site, except standard search-engine indexing; or
• copy, frame or republish Site content except as these Terms allow.

4.2 Information you submit. When you submit a form or contact us, you agree that the information you provide is accurate and that we may use it to respond to you as described in our Privacy Policy. Please do not send passwords, payment card numbers or other sensitive information through the Site's forms.

5. Intellectual Property

5.1 The Site and its content, including text, graphics, logos, design, layout and code, are owned by Want Web Design or its licensors and are protected by copyright, trademark and other laws. "Want Web Design" and our logo are our trademarks. You may view and print Site pages for your own information, but you may not otherwise copy, modify, distribute or create derivative works from Site content without our written permission.

5.2 Websites shown in our portfolio belong to the respective clients and are displayed with permission. Their names, logos and content are the property of those clients.

5.3 Copyright concerns. If you believe content on the Site infringes your copyright, please send a notice to jim@wantwebdesign.com that identifies the work, the material you believe is infringing and its location on the Site, your contact information, a statement that you have a good-faith belief the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your physical or electronic signature.

6. Third-Party Links & Tools

6.1 The Site may contain links to, or use tools provided by, third parties (for example, scheduling, payment, analytics or map services). We do not control and are not responsible for third-party websites, content or practices, and your use of them is governed by their own terms.

7. Disclaimers

7.1 The Site and its content are provided "as is" and "as available." We work to keep the Site accurate and available, but we do not promise that it will be error-free, uninterrupted or free of harmful components, or that information on it is complete or current. Content on the Site, including blog posts and guides, is general information and is not legal, financial, tax or other professional advice. To the fullest extent allowed by law, we disclaim all warranties about the Site, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Warranties for our services, if any, are only those stated in your signed Agreement.

8. Limitation Of Liability

8.1 To the fullest extent allowed by law, Want Web Design will not be liable for any indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of, or inability to use, the Site, and our total liability for any claim arising from your use of the Site will not exceed one hundred dollars ($100). This Section applies only to use of the Site; liability relating to our services is governed by your signed Agreement. Nothing in these Terms limits any rights you have that cannot be waived or limited under applicable law, including the Texas Deceptive Trade Practices–Consumer Protection Act.

9. Indemnification

9.1 You agree to defend, indemnify and hold harmless Want Web Design and its owners, employees and contractors from third-party claims, losses and reasonable legal fees arising from your misuse of the Site, content you submit, or your violation of these Terms or of law.

10. Governing Law & Disputes

10.1 These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any lawsuit relating to these Terms or the Site must be brought in the state or federal courts located in Harris County, Texas, and you and we consent to those courts. Before filing suit, please contact us at jim@wantwebdesign.com so we can try to resolve the issue informally; we will both try in good faith for at least 15 days. Disputes about services are governed by the dispute terms in your signed Agreement.

11. Changes, Severability & Contact

11.1 Changes. We may update these Terms from time to time by posting a new version on the Site with a new "Last Updated" date. Changes apply to use of the Site after they are posted and do not change any Agreement already signed.

11.2 Severability & waiver. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and us about use of the Site.
